Presidency Issues General Regulations of the Organic Law of the National Public Procurement System
Executive Decree No. 193, which contains the General Regulations of the Organic Law of the National Public Procurement System, has been published. The following key aspects are highlighted:
- The “Value for Money” principle is developed transversally, incorporating an analysis that considers quality, sustainability, innovation, and the life-cycle costs of goods, works, or services.
- Within the framework of transparency, universal access is required through open data, interoperability, traceability, business intelligence, and an open contracting policy.
- Parameters are established for the Single Supplier Registry (RUP), including validation criteria for public/private experience by CPC, as well as an integrity index and due diligence requirements.
- Mandatory (biennial) certification of operators is required, incorporating anti-fraud controls.
- Preference is operationalized for national producers, Micro, Small, and Medium Enterprises (MSMEs), actors of the Popular and Solidarity Economy (AEPS), artisans, women, youth, and the circular economy — provided that the offer is of national origin in accordance with established thresholds.
- In the case of procurement of medicines and medical supplies, corporate purchasing and the incorporation of traceability mechanisms are established.
- For security and defense procurement, a reserved regime is set.
- In consultancy contracts, parameters are established for quality and cost, which must be equal to or lower than 20%.
- In school meal programs, corporate auction procedures and specific catalogues for rations (sanitary technical sheets) are applied.
- In engineering, procurement, and construction (EPC) contracts, the use of Dispute Resolution Boards (DRBs) is mandated for processes equal to or greater than USD 10,000,000 (ten million dollars), and international bidding templates must be used accordingly.
- The Anti-Money Laundering and Anti-Corruption Unit of SERCOP is strengthened, with a mandatory reporting duty to the Financial and Economic Analysis Unit (UAFE).
