Amendments to the General Regulations of the Organic Law on the Public Electric Energy Service
Through Executive Decree No. 515 of September 29, 2026, the President of the Republic issued the amendments to the Regulations to the Organic Law on the Public Electric Energy Service (“LOSPEE”), which introduce new rules to develop electricity projects, strengthen supply, and remunerate activities in the sector.
Below, we summarize the main aspects addressed in the amendment:
- Generation and investment: it promotes non-conventional renewable energy and transition projects, and regulates participation in storage and ancillary services. Renewable projects provided for in the Master Plan will be awarded through public selection processes.
- Self-generation and new modalities: it allows self-generation surpluses to be allocated, without limitation, to regulated demand and large consumers; it updates self-supply and regulates Autonomous Energy Districts.
- Oil and mining projects: those not connected to the National Interconnected System (SNI) will be responsible for their own self-generation. Connected projects of up to 10 MW may, as agreed with the sector's governing body, choose between regulated supply with self-supply or self-generation to cover 100% of their demand. Connected projects of more than 10 MW must self-generate 100% of their demand.
- Security of supply: in the event of a deficit, rationing or grid problems, ARCONEL may regulate emergency generation and CENACE may order the disconnection of certain high-voltage consumers.
- Networks and payments: conditional mechanisms are enabled for customers or third parties to build distribution infrastructure, and new rules are established for contracts, tolls and the order of priority of payments in the sector.
As determined by the Executive Decree, the Electricity Regulation and Control Agency has eight months from the entry into force of the Decree to issue the required technical and commercial regulations. The modalities that require specific regulation will apply once such regulation enters into force.
